When may couples reconsider divorce mediation?

Rather than traditional divorce, you and your current spouse instead want to try divorce mediation. The alternative dispute resolution does not fit every scenario, so does it match yours?

Money Crashers explains times when mediation could do more harm than good. Determine if it may make sense to opt for a standard divorce.

Problems with addiction

If either spouse struggles with substance abuse issues, she or he could also struggle to show the spirit of compromise necessary to get the most out of mediation. Addiction often impairs a person’s reason and judgment, two essential cornerstones of mediation.

Higher costs

Couples who suspect mediation may not work for them may want to consider a traditional divorce. While mediation saves spouses from the emotional and financial toll of a traditional divorce, the process still costs money. If mediation does not work, it could inflate the overall price of a standard divorce.

The presence of violence

Even if neither spouse laid a hand on the other during the marriage, partners could become mentally or emotionally violent. Couples may want to save money by choosing to mediate their divorce, but their well-being could become an issue. The spouse on the receiving end of the abuse could be better off with help from a legal representative.

Unable to agree

Both partners must remain on the same page to make the most of mediation. That does not mean they must get along while ending their marriage, only that they must commit themselves to the legal process completely. That means communicating with either other regularly and honestly.

Mediation does not work for everyone. When couples know what they sign up for with the alternative dispute resolution option, they set themselves up for success.
